Chinese Patents do not automatically cover Hong Kong Special Administrative Area. To seek local protection in Hong Kong, Applicant should extend a Chinese application/patent to Hong Kong by two steps carried out at two different stages, i.e., recordation stage and registration stage.
First Stage for Standard Patents - Recordation Stage
To complete the first stage, Applicant is requested, within 6 months after the publication of the corresponding Chinese application, to record a request before the Hong Kong Intellectual Property Office, by filing a request and submission of supporting materials. The 6-month period is not extendible and recoverable.
Second Stage for Standard Patents - Registration Stage
To complete the second stage, Applicant is requested, within 6 months after the grant of the corresponding Chinese application, to record a request before the Hong Kong Intellectual Property Office, by filing a request and submission of supporting materials. The 6-month period is not extendible and recoverable.
