Before file an invalidation request against a valid patent, a stability analysis may be performed to examine whether the patent is stable in scope. Some patents are granted even though they were not supposed to be granted.

This occurs due to many reasons, for example, prior search misses relevant reference documents, deficiencies are not recognized by Examiner, or claims are broader than can be allowed.
