Applicant may file an Appeal against a Rejection Decision made by the SIPO within 3 months after receipt of the Decision.

The Appeal will be reviewed by a panel consisted of three examiners. Appeal is normally performed on paper and interviews are normally not allowed.

Before the Panel begins to review the case, the examiner who rejected the application will be requested to reconsider the case. If the examiner insisted his/her opinion, the case will then be reviewed by the Panel.

Appeal normally takes 12-18 months.
